Yesterday the Supreme Court made a ruling that made no sense unless you know how to look. Youngkin only tried to purge 1600 voters in a purple approaching blue state. Literally NO poll shows Trump winning. Yet the Rape court ruled 6-3 in favor of ignoring federal law and letting him perform this illegal action.

Biden. Did. NOTHING.

Let me repeat that.

I didnt say they declared the law saying you cant purge voters for 90 days unconstitutional. I didnt say they said the law didnt apply and here is why. Because none of that happened. The rape court just said, "Yes, go ahead and BREAK THE FUCKING LAW.

The situation is very fluid, but by the indicators I trust, Harris may win MASSIVELY on Tuesday, but its not over. Because the current plan is to nickle and dime to death every ballot, every decision and every single loop hole, and the court yesterday just did a trial balloon to see what would happen if they ignored the law and ignored the constitution and just unilaterally hand the election to Trump.

And Biden. Did. Absolutely. Fucking. NOTHING.

This old tired stupid bipartisan high road FREAK is just gonna SIT there while the Rape Court hands the Republic to a Nazi. This loser, this poser, this total useless FREAK did and is going to do NOTHING about the rape court being illegal or unconstitutional.

Impending Death Splurge - Court Nullification

The elaborate series of checks and balances in the 1789 constition breaks down when two of the three branches of government are compromised. For example, if the Presidency is working, but the congress and courts are corrupt; the President's check on selecting the court do nothing. Congress is supposed to impeach the courts if they go berserk, but when one half of the two houses is run by nazis, then they will impeach nothing. The constitution says nothing about the court legislating unilaterally, but if everyone treats the court as if it CAN do so, then it is granted godking like powers that are found nowhere in the document.

Today, the US Supreme Court let stand a lower court ruling that allows Virginia to purge 1600 voters IN DIRECT VIOLATION OF FEDERAL LAW. The 1789 constitution makes the court the supreme one in the land, but NOWHERE does it give it the ability to simply Ignore the Law. Even if you accept Marbury v Madison, let's be clear here. The US Supreme Court did NOT declare the 90 day Federal Moritorium on changing voter rolls unconstiutional.

They just ignored it.

When I called my Senator to beg him for Biden to have a plan, ANY plan besides "an army of lawyers" and "Shocked Pikachu Face" if the court just says,"Donald Trump is President" IGNORING the Electoral College. The democratic plan seems to be "well surely they wont..." THEY JUST DID. They just IGNORED the law, unconstitutionally. The constitutional check and balance is impeachment. Yet congress wont do that. What is plan B?

Ladies and gentlemen, let me answer that for you. The answer is that there is no plan. Short of a full Andrew Jackson there is NO PLAN. "An army of lawyers" only works if the courts are not rampantly corrupt. And if Biden doesnt do anything, that's how you get an actual civil war folks. Where the presidency is CLEARLY given to Harris in an election and the courts just give it to Trump anyway, if Biden sits on his hands, then the bad guys win even if everyone knows its illegal and the military is going to most likely follow the person the chief justice administrers the oath of office to and is sitting in the white house EVEN IF IT IS PATENTLY ILLEGAL. If the President goes along with it, AN UNENFORCED LAW DOES NOT EXIST.

Thats why electing a president who isnt tired and old matters. Thats why its a risk until Harris, who has fire and a spine, is able to take over for the dodderer in chief. The great Charlie Brown nap will allow the bad guys to march into the white house without a shot being fired if the President isnt willing to stand up for the law, which is why he should RESIGN, the day after the election.

Why would we do anything but align the totality of every element of our society; cultural, technological, government, commercial and even religion to remove the fucking threat? The Enemy from Within is real and its the American Nazi party, that has adopted nazi ideals. I have a real legitimate fear from Maga Proximate Family that on Day 1 I will be reported to the enemies list. If you are naive, drunk and stupid enough to believe that the 2020 election is stolen, you are capable of reporting me for Stasi like camps. These people want to take a woman and shackle her to a hospital bed to have her rapist's baby. They lie like they breathe. They will change what they believe to fit the moment as dictated by the leader.

Why should these people be allowed to participate in society? Why should these people be allowed to raise children? Why should anyone who wants to reinstitute slavery for their religion or over turn our republic with cheating and false allegations of electoral fraud for their minority beliefs be accorded any degree of mercy or dignity? You wanna talk to me about the Treaty of Versailles? If the people who had experienced WWI had had any IDEA that WW2 had been coming, do you think they wouldnt have salted the Earth on Germany? Why should ANYONE show the slightest mercy to Maga Nazis?

The repeated lesson taught to us by history is that the lesson of the Treaty of Versaille was mercy to their opponents which is how we got West Germany...except West Germany is all about licking the testacles of Russia and only giving Ukraine the barest support it needs without being shamed by the rest of NATO. Impending Death Splurge - Dismantling Capitalism

I dont really expect any of my ideas to make it into the final form of a constitution, but they are useful for thought execizes, and let's assume the following for this one:

-The National Chorus is given the authority to create charters for businesses hoping for a similar shielding that Corporations have today.

-Businesses must register at the Federal Level given the failure of states to properly regulate corporations.

-Capitalism has no right to consider itself an inherently useful and non dangerous ideology, merely needs to be shown that it always causes statification and corruption being baseline criticisms, but the fact that Capitalism was used to deliberately delay the already herculean task of climate change means that Capitalism may NEVER make the defense that "it works better than the other systems." It doesn't. It just a pretty good system that works until it runs out of other people's money to pay for it.

-Since the new government will bypass the existing congress, there is no inherent obligation to preserve the existing status quo since almost all money earned in the last 50 years was earned by theft or corrupt regulatory capture. That means all if it is subject to ethical claw back.

-Therefore, former corporations will be forced to PROVE that they provide a public benefit to the new society rather than just automatically retain its liscence to operate. It can be turned into a worker owned collective charged by the government. Almost all wealth in America is created by theft, which means all of it can be redistributed.

With these postulates, I will throw out the idea of killing two birds with one stone. Use companies willing to help the new government transition as getting a 20 year moratorium on their disolution in the United States as long as they dont try to transfer their wealth out of the United States, provide an accepted public good (besides making profit for their shareholders), and that they dont fund conservativism or other terrorists or enemies of the United States at home and abroad.

This will create a herd effect. As businesses begin to realize that the new constitutional movement is serious, they will realize that the talk of disbanding them will also be taken seriously. Capitalist help to promote and encourage the new government could speed the movement directly. Enemy companies that want to take away the right of the people to rewrite the constitution without being bound to the rules set by slave owners; fully in compliance with international law, would make the case in their future trial before the National Chorus that their company should not be granted a charter and in certain cases, like Fox News, referred to the Hague for trial on Crimes Against Humanity for climate change denial.

Companies that elected to responsibile governance structures, including encouraging unions and encouraging worker ownership of a significant amount of the company would be welcome in the new regime. Organizations that elected to champion fascism would and should be treated accordingly.

Eventually, a philosophy that is coherent and opposing Capitalism will emerge, but for now, taking anti capitalist steps including severe financial regulation, total destruction of business free speech, and the requirement that federal charters be used to force these organizations to serve the public that allows them to exist are all steps in the right direction that could actually work.

Impending Death Splurge - What to Watch For Nov 6th

The Election itself will go fine. There is no guarantee of anything but all the indicators that I actually trust and follow common sense say Harris has this in the bag.

It is now well known that Donnie Darko is not receiving public funding for the transition and some people believe that means he plans to steal the election. We knew this the instant he wouldnt admit he lost and ran for relection. We know he has said he will plan the 1/6 Treason Weasels, and we know that he has said he will pardon anyone else. The court gave him a writ of immunity as a virtue signal that if he gets them a case similar to Bush v Gore, they will steal the election.

Time is running out Prior to Jan 20th to plan for the coming coup, but if you want to know how to do this, watch this video. If you want to know what things will be like under a Trump regime, watch this video instead. If you want to be as prepared as possible, watch/listen to both.

The election will be fine. Its the stuff Trump is going to do after to make noise or say that the whole thing was rigged and who will be moving to help him do that that is in question. Expect the entire Republican party that hasnt endorsed Kamala Harris to join with the Leader on messaging on this. Heaven and Earth will be moved to try to move the election to the House of Represenatives or to the Supreme Court or both. Even if the EC is 300 to 157, the Republican Party will contest the results and say that Trump is the leader. This is the price you pay for allowing lying and making it legal. You allow an entire party and wing of ideology to create a false narrative and be willing to steal the results of the election, even when they're asking you to ignore the noon day sun.

The point is, you're going to see noise and chaos. There is no conceivable way this will be over with the election and it very likely wont even be over after (or if) Harris takes the oath of office. You see, you have to remember, BIDEN is the President until 1/20, and while every Bluewho will cheer about Biden's wise choice to step aside for Harris, the fact is he COULD do so the day after the election. Yes, she has a vital role tie breaking in the senate as VP, and yes, a divided senate might not allow Walz to serve as VP, meaning its dangerously putting Johnson as one heart beat from the presidency. On the other hand, Biden is tired, and has already shown no willingness to deal with Dejoy, Garland or Wray or anyone else right of center in the government or remotely Trump leaning.

So use logic here. If we know with ONE HUNDRED PERCENT certainty that the Republicans will use ANY and EVERY excuse they can to bring the election before the supreme court, then that also means that the Rape Court will go along with almost ANY decision that makes Trump president or even just kicks the decision to the House. But if the court makes a blatantly and unconstitutional decision to just throw the election to the Republicans, then the President who has immunity from prosecution for his official acts; and has a choice. Will he abide by the court or the constitution? His oath of office is to the constitution but if the court ignores it there is no other constitutional option save impeachment (which I mean, its Congress....) or to refuse to enforce an unconstitutional decision. Can we REALLY count on Biden to do this?

Ergo why Harris should take over as President the day after the election; it wont happen but its well worth the risk not to make Biden have to decide to enforce the will of the people or not....

Impending Death Splurge - The Deep State as the Ally of the Rural

We've previously argued about the idea that a majoritarian electronic democracy with very reliaable non corruptible state structures could actually work in a way that makes no one happy but makes Representative Democracy look as quaint as Fuedal Monarchies did in terms of abusive structures. But if Just In Time flat structures do exist; with the bite of the state but the nearest utopian style minimalism that reality still demands for a functional state. But for the state to do the things that most people want it to do like deliver the mail and protect you from slavery and poverty and loniliness it will need to have structures. It will need to have institutions. And at some point, you make decisions in a fair society based on geographic region. It is only acceptable to make decisions by region rather than by population when you get to the level at which society must regard the needs of the one with the needs of the many. The many MUST recognize the needs of the invidivudal, because the individual is the many.

Which is a lot of fancy words for saying take what history says with a very heavy dump truck of salt. On the other hand, in the normal real world, people want to have a reason to get up in the morning; have something to do, and not worry about their basic needs like feeding themselves, clothing themselves, and being able to spend their time doing the things that they want to do and do it at level for their own needs not those of a small elite few who are particularly assholes. That means democracy, there is no way around that, and that means that there will be disagreements about how to do things. So you need to decide where we need to be free as a society and be free as an individual and they are not the same and they are the same. And extermists will continously and sometimes with out reason push their own view there; when most of the time common sense and intuition says it has to be a balance, and that no one can really decide what that balance is but the majority.

But everyone lives somewhere. And your sense of where that somewhere is may very. For some people, their whole world is a part of a city that is a few blocks and everything they would ever want government to do should cover that area and what those people in that area would want is all government should ever be or do. And then there are some who believe the world should have no borders and that anything that happens within those borders should apply to everybody everywhere. And for most of us, we dont really think of the world like that. We just want things to be normal and let us care about what we care about. But for those fringes, it isnt about me or you but really about grouping people all as one big whole for everything that it is they care about against the things that people in one part of the country want compared to everyone else. And those people will form coalitions of the things they want. That's been happening for as long as we can remember.

Even in a minimalist flat utopia, nobody wants to have trash dropped where they live, no one wants to be the last in line for resources or even the newest upgrade to vital technology like telephones or the internet or whatever random thing it is next infrastructure wise. Your system of government needs to understand a sliding scale of invidivuality by geography to understand that you cant let a group of people dominate even a small geographic area against its will any more than you can decide to make just .000001% of your population be slaves. You are either all the way against slavery, or you are a slaver. And no one wants just a little poop in their sandwich. That means in a just society, a truly just society you need to balance the needs of the city or even the city block against the needs of a nation. You need to treat the people of 16th street and Elm just the same as you treat the people of Wyoming.

And to me, the sweet spot for that to happen isnt some demonic compromise of self sovereignty of the many by minority geographic tyranny. Its to make sure that when the rubber hits the road to decide whether a street is going to get paved here or there, that both parties have an equal voice in the room. And that means that the people who show up and engage in the policy making at the institutional level have to have the right to do that. It comes to how you spend your time and focus. I dont have all the answers, but I know at the department level, the actual top level of execution, those that want to be in a self identified geographic location should be able to have their interests equally represented. And I dont know what that structure will look like, but I imagine a just version would be as chaotic as the web of life itself.

Impending Death Splurge - Abolish the States

I come not to Praise the States, but to Bury Them.

So let's start off with the fact that I am not biased against Rural areas, but rather evil, and since Conservatism is the most consistent and reliable form of evil and one of the areas conservatism tends to manifest the most is in Rural areas, be aware of my perspective. Indeed, to me, Rural areas should be serene and dynamic places with schools just as good as cities, where people can work from home and still live and shop locally. Before dealing with a psychotic boomer landlord, we had nothing but positive experiences in Greenfield MA, but that is because the state actually provides some decent infrastructure for the city in education and other benefits instead of turning it into Laboratories for Meth. The term "Laboratories for Democracy" refers to a supposed strength of the federal system in which the states can try localized solution to wide spread problems. And sometimes this has worked; the legalization of marijuana, reform of Gay Marriage etc, but for every success there are ten failures.

The American South and its record on rights and now the American Red State and its record supporting fascism is simply unacceptible. And for a long time, rural areas have resented cities and in several states in America, fuck things up for them as much as possible. Almost every red state does this; as well as New York. in the case of Illinois or Oregon, its the opposite with more progressive and enlightened urban areas dominating the politics of the rural areas. Needless to say, what you never see in any state except Massachusets, Vermont or Hawaii are education rural areas fighting educatated urban ones. When 47 out of 50 laboratories let a third of their employees snack on lead paint chips like potato chips, then something is not working. And the States allow walking talking pieces of Excrement like Desantis or Noem or Abbot to literally terrorize their citizens, then its time to review the entire concept of the state.

So if we federalized the functions provided by the states, what would that mean? Well, it would mean that if we had a decent federal system of ranked choice voting and multiple parties and federal recalls then conservatives could never steal the opportunities of children ever again. It would mean a federalized police force would have federal standards for murder police; and dont get me wrong, federal law enforcement still murder with impunity but the worst offenses still get investigated by the inspector general and the FBI instead of off the chain sherrif departments or private militias taking over local governments with banned books and terrorism in local towns. We would have parties that were better balanced.

The consistent thing I keep hearing from liberals about the solution to nazification is education. And that is readily apparent in Massachusets; centuries of prioritizing literacy and education has made Western Massachusets remarkably nazi free for a rural area. But the operative term there is centuries. And let's remember that Europe still has its nazi parties in the far right or its nazi adjascent ones in conservative ones. But Europe has until the last few years proven far more resistant to nazification, and none of them except Germany had a federal structure. And yet despite the anti nazi laws (which I approve of) the AfD is running amok in the rural east. And its not like Germany hasnt spent money there. No, when you have local governments of a certain size, there is a risk of conservatives taking tehm over.

Now until the last few years, I've always liked Federalism. I still love the system in theory, but I have to ask this to counter the idea...Which of your rights do you want conservatives stealing or fucking up? Conservatives fuck up and corrupt and destroy everything they touch, and while they might gain control of a national government, they can be redone at the national level. Do you want your kids to grow up ignorant? Or framed for taking drugs they never touched by the local cops? Do you want your parks ruined and slimed by polluting businesses? Even your local traffic ordinances can be weaponized by fascism to try to kill you or have no safety mechanisms whatsoever. I know I dont want conservatives in charge of anything, and one way to do it is to ensure that there are no local governments for them to destroy and corrupt.

Impending Death Splurge - Gaming Out the Constitution

So I've said before that we need constitutional societies to teach this as a wide spread cultural practice; we should have lectures on new constitutions and whole univerisity departments but they should also be as common as historical reenactments. The province of reform and better government are something that belong to all of us and you can't have a grass roots democracy if there isnt civic training and civic participation. But classes are not a proper measure of how to do this. One of the most educational experiences I ever had was a program in high school called Youth in Government where we went to the Colorado State Legislature to actually make mock bills and have a shadow governor, shadow senators, shadow press agents and shadow representatives. Government is a practical active skill and all members of a democracy should understand actively how it works. When you know what a legislative committee is or what your legislators are doing it makes it less arcane which increases transparency and accountability. You know, for example, how terrible Republicans are in doing any kind of governance whatsoever, and how inept democrats are at treating fascism like the threat that it is.

One of the most interesting LARPs I've ever taken part in is the NSDM or National Security Decision Making Game, where two cells are typically made with roles and political positions representing the interests and structures of two competing governments and a baroque but functional system to resolve mirrors of the real world for things like the US vs North Korea or Iran vs Saudia Arabia etc. The games dont mimic the real world exactly, nor would they pretend that, but they are great ways to highlight one system vs another and how they actually work when the sausage of decision making actually takes place. My perfect example of how to do an exercize that could happen in every school in America would be a three day session, where you spend the first day teaching people the basics of what a constitution is, what governments around the world have done and what will be happening the other two days. The second day would be a larp and also a constitutional design session where you actually make a functional government (or disfunctional government) and the third would be a larp showing the government that people just made actually working in a crisis. This serves many purposes; including demystifying the process of making one, and also ensuring that people see the consequences for design decisions; like how baroque the Electoral College is and how it is a miracle that it took until 2020 before it was a serious threat to our democracy.

I really intend to run this eventually; though stability has thus far not allowed. In another blog I'm doing a bucket list and will be adding this to a bucket list. I think that the value of this exercize is you can explore about a lot of different systems of government and see what works, and once you do you can also see how easy it is to find something that works a hell of a lot better than the current crap 1789 constitution. I've said it before and I'll say it again; the 1789 constitution at the TIME IT WAS MADE, was brilliant and well ahead of its time; visionary even. But we've had close to 250 years to learn lessons from it and we've learned a lot, many of which I am applying as able to this political blog, but the short version of it is, the current systme is clearly not working by any defintion of the word and needs to be reformed. The problem is, we've ossified as a culture and trust our 'political leaders' to have our interests or that some other magical leader will come along and initiate this process.

I've made a poem about it, but I'll retell the story here. Once I sat in a movie theater with my wife and the projector stopped working. It was a crowded tehater, andw e all sat there waiting for someone to fix it. Five minutes went by, and I looked around, and it was apparent that everyone else was thinking the same thing. I stood and went and got the people to fix the damn thing. I have always known and understood that there is no "Someone Else." I dont agree with the politics of the documentary "Waiting for Superman" but I do like the point of the title and the point the documetary that people knew education wasnt working but that they were all sitting around waiting for some magical messiah to fix things. To fix our political process we all need to roll up our sleeves and come up with a strategy and then take over the democratic party (since the Republican party is broken and pointless beyond repair) and initiate a constitutional fix.

It sounds like pie in the sky, but what's the alternative? It's not like the Democrats are actually going to fix things on their own. Why should they? They have a good thing going where they force progressives to vote for them by threatening them with the nazi republicans, and thanks to Duviger's Law and a lack of Ranked Choice Voting make third parties effectively non existant and useless in the United States. Even if the Republican Party implodes; what's waiting in the wings? The Lying Liberatians or the Russian Anti Vaxer Greens? Its the Democrats or nothing, and we need a whole hell of a lot more at this point to fix things than just a couple of laws. The Democrats always promise to make us live in Shangrila if they get the Holy Trifecta, but those are at best incremental reforms and dont address the fact that the 1789 Constitution allowed one of the two parties to become full on insurrectionist Nazis and has totally failed to address climate change. Look, I'm not saying the democrats havent done good things; Biden's Infrastructure Reduction Act and the Election Security Act were good things, but neither of them nor a damn thing that Biden has done or that Harris promises to do if she gets the Magical Holy Trifecta (blue no matta who!!!) will fix the underlying problem of Nazis.

Impending Death Splurge - Fungible Courts

The court system for the United States was very advanced for its time; 3 layers of appeals and all the lessons learned of the English legal system. However, conservative justices have shown that tyrants in a robe are still tyrants just the same. Going by the Anarchic principal that Hierarchy is corruption, the trick is to make appeals process as flat as possible and ensure that the jury is made of qualified experts and peers. We can have 12 judges, randomly selected from the population, with a single person jury who takes the votes of the judges, breaks ties and also is able to rule evidence that doesnt qualify as inadmissable. This ensures that 'qualified' judges dont get to corrupt the legal process; and precedent while non binding can be considered by the legal clerk or other experts in the law. The courts should be owned by the population and entirely incorruptible.

A cabinet will have many ministeries or if American they will likely still be called Departments with Secretaries...but seven positions should be coequal and share the provisions that the current President as Head of Government has the following:

Head Legislator - This position directs the parties legislative efforts to push an agenda of the governing coalition. They are effectively also the head of the Party that runs the coalition.

Head Commander - This position is specically the civilian commander and chief of the armed forces. This person has no other duty but to command the military as dictated by the dictates of the parliament and if time permits the populace at large. His duty is to call and have votes to ratify a declaration of war and justify why it is needful. It should be ratified by the population or it doesnt happen. In war, he commands the army and war strategy.

Head Justice - This position represents oversight of the prosecutoral agents in each executive department or agency. He directs strategy and also directs the prosecution of all laws enacted by the Parliament. He can investigate anyone. Effective Head of all Law Enforcement agencies such as the FBI or DHS.

Head Treatier - This is not a seller of treats but a souped up secretary of state who is in charge of ensuring ratification of all treaties or international participation in multi national government organizations including Military / Mutual Defense treaties. He can veto any action by the Head Justice or Head Commander that violates an agreed upon international treaty. He is also able to investigate the Head Justice for criminal violations so that no one is in charge of investigating themselves.

Head Secretary - Runs all other departments or agencies not covered by Justice, State or Defense. May veto any action covering a law or regulation effecting their agencies. In charge of earned benefits and laws and regulations governing State Charters created by the National Chorus

Head Ombusman - Always has standing in any court. In charge of defending laws not enforced by anyone else. If the law isnt enforced by him for a period of time then it becomes null and void. In charge of receiving direct citizen positions and representing them in court so that the individual has a representative at the highest level of governments. The Elites deserve nothing.

Head Dodger - Able to veto over all other positioned. Named after the Artful Dodger and is in charge of admistration of courts and agencies that enforce the will of the courts. Prosecutes or decides all Contempt enforcement whether of court or the Parliament or the Chorus or the National Assembly/population. Is the effective voice of the National Assembly/Population at large and in charge of ensuring that the popular will is maintained and that election integrity ensures cooperation with the government. Also always has standing in any court.

All Vetos can be overridden by Parliament AND/OR by the National Assembly / Population.

Impending Death Splurge - Flat Parliaments

So if we are flattening and democratizing government to keep capitalists and conservatives from destroying it, we need to make the voter the ultimate arbiter of everything and allow every judicial decision, bill, policy or appointment to be appealed to the people writ large, but we should also make people only need to get involved if they want. Parliaments mix party interests in the legislative and executive function, and I think having a cabinet of agencies with a devolved prime minister spread wide and flat allows parties to form deals which is what parliaments do best.

But the party law makers as legislatures should only draft legislation which must be ratified annually by the populace whi can vote simply by colored party line or get into the weeds and ratify or not ratify by individual bill; as well as have an option demanding a follow up election where that bill can be separated by sections and voted for or against. If the populace is educated and involved this endures a good society indeed but if its just parties them the parties know they can jam crap down peoples throats like the UK parliament and nasty tories; since they can be recalled at any time and ALL legislation but be ratified by the majority of the population.

Corruption is still possible, but corruption is alway possible but unless the population has some reason to get something out of the law, they will never approve it and since laws must be reratified every year that means it wont last if people dont want it.

Impending Death Splurge - A National Transition Plan

Let's all remember that the 1789 Constitution was illegal. The Articles of Confederation were so broken and so useless that the leaders of the country, including many of the Founding Fathers, set up a constitutional convention with the idea of fixing the Articles and instead they met in secret to propose an entirely new government. There was no Article V in the Articles of Confederation. The people just DID it and then it was ratified by the states.

The legitimacy of the state and the power to govern derives itself from the governed; even when not a democracy. Even when it pretends to be otherwise like a Monarhy or a Theocracy it still gets its power from the people who govern it. Under the 1789 constitution, you can't abolish the states, but if you make a constitution from scratch, ratified by the people at large. If the majority ratifies it, then its just as legitimate if not more so, then the old one.

Meaning, if the government doesnt stop a new constitution being made, or people voting on it, then you can get a new one. Of course, the old government typically has a say in that with this thing called the United States Military. But the Terrorist Red States can be circumvented from a tyranical 3/5th or 2/3rd majority impossible in their fly over minority rule, without abandoning the blue cities trapped in their Terrorist jurisdictions by focusing on the Democratic Party (or technically any other party but since we want to actually win and not be terrorists or nazis thats the one I'm writing about.). Run a candidate with the platform of holding a vote for a new constitution and all they have to do is prevent the military or DHS or FBI from rounding up the people voting on it.

Congress will babble of course but if a new congress is assembled and disolves the old and the President legitimizes it, then that automatically empowers the new governement. And there is almost nothing worth keeping about the current highly broken system.

Impending Death Splurg - Larping the Church of Crime

A larp stands for live action roleplay. The church of Crime is an invention of DC Comics with Organized Crime who worship crime and the God of Evil Darkseid. I always found the concept clownish but its no more ridiculous than the Republican Party which has such fools and evil idiots that any cartoon villain looks well balanced and well reasoned compared to it.

So the way you test your government is larp it out; pass bills, make decisions, pass laws but make sure that at least a third of the members belong to the Church of Crime. That way centrists and lecturing liberals wont squirm at making fun of their tools and pals the Republicans or the Conservstives

A government strong enough to survive two or three daya governing with the church of crime in it is far better than some shangrila utopia that hasnt been tested. A government that is going to help people has to be built from the ground up to keep conservatives out of power and to minimize that power one they or their party... i mean church of crime... are publicly declared as such.

I intend to eventually organize larps in just such a way.

Impending Death Surge - Red Team vs Blue Team

In the Military, exercizes are often done with one team pretending to be the enemy and one the home team. This doesnt predict what the enemy will due but it can predict what they may do and properly done, even what they are likely to do. Any new constitution must have itself tested against the forces that might destroy it.

So if I can unilaterally condemn capitalism as a failure for Climate Change and Fascism in the Free World alone....then next on deck as a total failure is Conservatism. I'm not going to get in other people's weeds of how they define it. I've known its been a problem for 15 years and have been seeking a legal definition of how to forbid it in a way that doesnt flat out outlaw Freedom of Association and I've come up with this one.

Outlaw any organization that does 2 of the 3:

1) Is Nostalgic about the past

2) Demonizes the Other

3) Lies like they breathe

I've found examples of this behavior in every human society since the dawn of time fictional or otherwise. Sometimes they are reactionary or 'movement conservative' or even communist but they ACT like Cnservatives. The Khmer Rouge were communists but they did all three of those things. A party that demonizes the other is going to go fascist if they arent put in check. A party that lies like they breathe is VERY likely to be conservative because conservatism favors lying. And lyrics to "Tomorrow Belongs to Me" aside, Conservatism always talks about 'the traditions of our fathers' and how the evil immigrants are stealing their jobs etc etc. Simply outlawing a flavor of this is going to have the same effect that Germany did outlawing Nazi, only to have supermarket generic fascism in the AfD.

Far Right parties if you describe Far Right as Anti Immigrant are THE most prime targets to get violent, to accept and encourage lies, to tactically be willing to do anything and everything to win elections including lie cheat and steal. We dont have to guess about this; the Axis of Fascism has allied all over the world; Bannon attends meetings with Putin and Slovakia and Hungary are clearly aligned with Putin. China, Russia, Saudi Arabia and Iran are all allied to fuck with the US; even though they fuck with each other. But Saudi Arabia has its thumbs and fingers in nearly every pie undermining democracy up to and including particularly the Trump Family and Jared Kushner.

Lies do not work in a Market Place of Ideas. And its not like Conservatism ever helps anyone except the Rich. Everything they say they believe in is a lie; everything.

Impending Death Posts - JIT Economic Governance

The following should (to me) be in any new constitution created by a democratic society.

1) Forbid public paid political expression from the top .01% income of the population. You can be rich or you can criticize or publicly influence the government, but you cannot do both. Once you become that rich, your ability to corrupt a functioning democratic government is sufficiently high that you dont get to contribute to political campaigns, political access campaigns, political special interest groups; none of it. You can donate to charities, but those charities must also receive small donations from non rich people to equate to half their income, and you dont get a seat on any board (governing or advisory) of a charity or NGO that attempts public advocacy or to influence public opinion or public governance in any way.

Full stop, do not collect $200, do not pass go.

2) The upper income tax rate is decided independently with no exceptions of any kind. Even the legislature or the government itself cannot adjust this formula short of a full constitutional rewrite and any new constitution would be idiotic to allow anything else. No exceptions. None.

The upper income tax bracket should go up by 1% if the median GNP per capita of the lower 90% of the population goes down relative to the upper .01% percent. If the median income of the lower 90% relative to the upper .01% goes up for 10 years in a row, then the upper tax rate goes down 1%. If it EVER goes down, the 10 year clock resets, but if it KEEPS going up, then the upper % can keep going down to 0.

If you are rich and want your taxes to go down, you make sure that EVERYONE prospers and you cant bribe the legislature to do it.

Full stop, do not collect $200, do not pass go. Tax breaks are for the not rich.

3) Unionization is a right. It should be unalterable by congress except to enforce the basic provisions.

a) The union must always be democratic.

b) The union should always be allowed to own at least 10-15% of the stake of whatever venture the workers participate in.

c) If the organization has stock, they must also be able to participate in 10-15% of any stock issued; ownership or governance or otherwise.

d) Any attempt to stop unionization means that the offending party loses all ownership stake in the organization and that the union gets first dibs in owning it (senior most union with the org if more than one union was supprsed) and anything not sold the union is sold for reasonable value by the government ont he open market.

e) The government shall provide a secret ballot platform which will allow people to join a union with ease, and the question will be asked every single year until at least 90% of the employees of the organization or endeveor are unionized.

f) Attempts to circumvent this law in anyway makes those found guilty ineligle to start a business or financial endevor for no less than 20 years.

g) Every year, members of the union will vote on whether or not the union is representing them. If the majority vote no, a new union is to replace it as organized by members of that union and no one else.

4) The populace at large determines what rights are; and there are some kinds of rights that are considered economic rights if the civilisation is right enough to afford them.

a) The Right to Housing

b) The Right to Food and Water

c) The Right to the Internet

d) The Right to Education

e) The Right to Transportation

f) The Right to Medical Care

If the government or civilization can afford being able to provide these things (or future things that a majority of the population deems reasonable) then it must be free for at least 90% of the population.

Every year, the population gets to vote on whether or not they feel these rights are being met. If they are not met, the government must come up with a plan to meet those needs. If not voted for positively in the next year, everyone in government who has been involved with solving the issue is out of office and a new government must be elected. Those who failed to meet these needs are not eligible for reelection until the issue is solved for that issue.

Anyone attempting to interfere with this politically, especially for economic gain or to promote stratification shall be disallowed from owning or participating in ownership of money generating enterprises; ESPECIALLY managing or owning property for rental purposes; commerically or residential.

5) Taxation or Wage Slavery is only allowed by the Government. A private individual or organization must have a liscence from the government to have an organziation that charges time tax in the form of wages; recognizing that coercion is the full monopoly of the government and that to have this ability leased or deligated from the government requires permission and continous (ideally annual) renewal and that the business or organization doing so is in risk of having its charter removed if it attempts to politically influence the populace away from its economic freedoms IN ANY WAY.

The population will vote annually on the effectiveness of this provision. If it fails, everyone in government involved in enforcing this provision is removed and not eligible for reelection until the issue is solved.

6) Any wealth disparity of more than 2000 times the lowest member of society is absolutely disallowed. Anyone who has an anual income of a Billion dollars, when the lowest earning citizen only has an income of $30000 a year will result in the seizure of assets from said person. Furthermore, transfer of assets from the jurisdiction of the government to avoid this penaly AT ANY TIME is to be considered a violation thereof. Stripping jobs from America to another country because you want to continue to be a robber baron or a slum lord means that you forfit your right to own property in the United States of America.

TLDR You do NOT have a right to be rich at the expense of others. Climate Change and Fascism in America have proven that insufficentl regulated capitalism are a threat to the people at large or even for the state to exist and function. It must be stopped. It can be stopped and that includes limiting the "rights" of those who choose to own or inherit property of a sufficent caliber to influence the opinion of the people at large.

Impending Death Surge - Governance Is Economics

In the Beginning, Civilization was made due to property and law to adjudicate its division. Not all early civilizations were Slavery. People dont NEED property to survive and prosper but a subset seems instinctively drawn to it. We've tried all kinds of alternative forms to capitalism; Anarchism, Communism and Socialism. None has succeeded in a democracy to scale, but that doesnt mean they can't. Frankly, humans need to be able to safely experiment to find the way that works best for them and over time, the way will work. We know certain things do not work because we've seen them fail. State Communism is centrally planned which is inherently less efficient because information is limited and any degree of flaws at the central planners reflects on the system as a whole. Morever, all State Communism to date has been at the point of a sword and that cannot last; fear only motivates people for so long. People can be motivated by things other than greed, but dictatorship encourage people to lie to survive and that leads to corruption because a shadow market and shadow government exist which has no law. Every black market thus far that I have read of in history was a capitalist one; not just because capitalism is what people are used to but also because its decentralized and easy to implement. What I am saying, is that all the constitutionial theory and law theory in the world does us no good if we dont build a system of government to protect us economically. We know and there are plenty of evidence that capitalism eventually creates unregulated and almost unstoppable corruption and stratification. If you DONT have flat government, your system; no matter how many checks and balances you create is amendable to corruption. And corruption is the death of democracy. Ergo, your constition, your system of government needs to start with economic regulation. The legitimacy by which it governs must ensure the well being of the vast majority of its citizens and if it fails to do that, then it needs to automatically course correct. There is never a situation where a government that only benefits the minority is a good government. And a capitalist government or capitalist economic system simply does not. Climate change alone proves Capitalism does not work. Even now, capitalist companies and corrupted capitalist parties and capitalist politicians dont just drill but drill faster and faster. Clear and objective evidence that anyone with a memory and not deluded by bullshit can see that every year gets warmer and the weather gets worse. Capitalism is responsible for this. And as such, Capitalism must be held entirely in check by any system of government that works for the benefit of its citizens.

Impending Death Splurge - Just in Time Recall

 My brief sympathy and investigation of Anarchy did yield some positive results.  Hierachy is abusive and can be corrupted.  Any time another person can have power over another, then there can be corruption.  Flat is better, but Direct Democracies can do dumb things; because People can be very stupid.  We all know this.  And we dont even have to speculate on hypotheticals.   Athens tried regular vanilla democracy and it turned out the loudest voice in the room could Shock and Awe people into voting against their self interests.  The Solution to this is to still have a Checks and Balances framework, but make the people fulfill the role of the Legislature and allow time instead of supermajorities to counter radical changes to the system.  Indeed, if you simply make your system such that you can have one person in charge of the army but that the populace is NEVER allowed to delegate their ultimate sovereignty and that the Tyrant or Leader or President or whatever can NEVER prevent the people from voting; then that solves one problem right there.

But a functional system (ie not anarchic consensus) is still going to have some hierarchy and some laws because unless you are engaged in Human Eugenics, we will always have conservatives and sociopaths walking among us seeking vulnerabilities in the system to exploit.  However, if we assume that Hierarchy is abusive then we need to take the concept of the Recall but apply Just In Time principals to it.  For those not familiar with the term, it means that in supply dynamics, you keep the supply chain 'lean' and as barebones as needed to still meet the needs of the end point of the chain.  Walmart does an excellent example of this by having the supply chain start the instant you by a widget to replace it.  Obviously, in the real world, this process also has to adjust for supply and demand such as the Christmas season.  (And sit down, you in the back squealing about Capitalism and government is not a business; you can still learn from your enemies.)

HOW does one apply a JIT mechanism to the recall? (And frankly, I think this should apply to multiple areas but we'll get to that).  The first and best area is just like Checks and Balances, you make sure that a JIT recall adjusts its mechanisms to the needs of its stakeholders; meaning the voters.  How? Well, you build in automatic feedback.  If the Recall is used, then you have an official confirmation vote of the replacement for the office within 90 days.  Not voting in this case would be approval, but if people are satisfied with the person who replaces the individual recalled then you dont need to do anything; it works.

If, on the other hand, you have sneaky nasty lying conservatives trying to trick the system like they do every time it happens with the recall in California, and everyone hates the Nazi the Conservatives vote in, then you have an automatic method that kicks in to the ballot that allows people to vote on; 1) The Threshold of Votes required for a Recall Election (more or less; thus ensuring that conservatives who will always want more votes required for a recall in a conservative state or less votes for recall in a conservative state will always allow the majority to actually decide to increase or decrease the threshold of recall.). You also allow the voters to increase or decrease the window of the election cycle, and you also allow the voters at large to select a committee to add parameters to make a recall more or less difficult if it is discovered that conservative/elite interests are abusing the system.

By building in correction mechanisms into the recall process, and making it so that the franchise or recall process CAN NEVER be taken by any system the voters may select, you ensure that the majority is never disenfranchised and that the system can be self correcting.  Conservative liars and sociopaths can manipulate the populace for part of the time, but over time, this gets harder to do since the Gullible Conservative is the only one that believes that Vaccines cause cancer etc etc etc.

Impending Death Splurge - A Constitutional Culture

 I have long felt that the first episode of any podcast involving the constitution should be about Jefferson's belief that the constitution should be changed every 20 years.  But to do that, you need a high bar of civic education where every school child in America gets together as a class and makes a constitution and then likely again in High School.  The act of making a constitution; especially if they act out making it work in a fashion similar to the National Crisis Decision Making game or "Larp" so they can see what works, and what happens when people have an agenda; where the parts of power that consolidate or where the exceptions or edge cases can be abused, they will get a much more concrete idea of how the actual government works and know what they are reading about in the news.

Constitutions must be changed.  I have spoken about this before.  People from 200 years ago would not and frankly could not know about what faces us today; the franchise of voting has expanded, the issues facing us are very different from weapons of mass destruction to gun control or social media.  Broad sweeping generalities like "Congress shall make no law abridging speech" has allowed the pernicious Alien and Sedition Acts, the House on UnAmerican Affairs Committee or FOSTA which persecutes women who try to make a living as a sex worker.  And yet at the same time, we allow Fox News or Cloud Flare or Corporate Personhood and deny basic services to our citizens.

Climate change alone proves there is a system failure of our government but no reasonable mechanism to address it with antiquated states and a bar that allows Oligarchs to dominate the process.  Change has to start somewhere, and grass roots is always where meaningful change for the United States has always originated.  It should start in school but I would love to see Constitutional LARP groups meet and build their own governments experimenting with what does and doesnt work long before state governments try out their own.

Impending Death Splurge - Head of State - The National Chorus

Our impending death is coming at 50/50, so before our death warrants are signed by Maga Project 2025 Stasi Death agents, I thought it was time to capture some thoughts while I still (potentially) can.

I had wanted to do these as podcast episodes, but I lost my windows machine and there was nowhere in the house in Springfield decent enough to do it plus odd psychic block..its been on my to do list but time may be running out so recording these thoughts as I can

The power of Head of State to me, especially as shown by the Crown, made me wonder how this could be used as a force for good rather than Tourism and Posh Imperialist Colonial Riffraff or Echoes thereof like the Presidency of the United States also being Head of State because Washington wanted to be treated as Posh to dignify the Presidency.   This as compared to Head of Government.  (And since while I do think Anarchists have some points; they decided that they would allow a Committee of Six to Hierarchy their ass, I'm not taking Anarchists seriously.)

The Head of State meets with other heads of State and has posh dinners and parades and pagentry.  But the thing is folks; there is a reason Fascists are obsessed symbolism is because the State is an Illusion.   But it is an illusion that has great power when accepted by the nation write large.  But civilization and society can do so much better than a symbolic monarch or a symbolic president with no real power or even great power and mixed duties with head of government and head of state.

In Ancient Greece, during plays, the Chorus represented the perspective of the common man.  Why must we distill our symbology in one person? Especially in America, we celebrate and embrace democracy.  I firmly believe that in a Secular society, Religion has no place in government.  I also dont approve of other societies that lay aside token members of the Legislature to indigenous peoples, minority religions or even women as a way of 'balancing the scales.'  But in the National Story this is different.  People's religions are sacred to them and they want to ensure that they have a part on the national stage.

The National Chorus would be appointed (ideally by a combination of executive and legislative branches) with some seats going to certain groups such as the First Nations, Oppressed Peoples or Oppressed Minorities.  It could also be an honorific in a Republic similar to the House of Lords and British Knighthood, with a lifetime appointment for great artists, scientists and the like.  It would be a place to tell the national story.

I do have some alternate ideas of what this body could be; I think they, not the head of Government should appoint ambassadors.  I think they, not the Government should approve national charters for non governmental organizations such as the United States Postal Service, National Trusts (which should do a public good and Replace corporations), PBS, The NEA, etc etc etc.  Right now these things rest with the President and I think that Government has a separate function from the machinery and symbology of state.

Finally, the reason I approve of this path is because some of the religious need to stick their moral dick in your face, and if it has to be somewhere, let it be in a body that isn't making laws or decisions about criminality.
